General terms and Conditions VOLTOR

Please read the contents of these general terms and conditions before using our website, since their use and any flight ticket order that they perform will be subject to them. You must print a copy of them and any order you perform for future reference.

  1. General
    1. In these general conditions:
      • "CONTRACT" means the contract between you and us for the sale and acquisition of the tickets requested by you using our website.
      • "TICKETS" refers to tickets for hot air balloon flights or tickets requests made in accordance with point 3 of these general conditions.
      • "WORKING DAY" means any day except Saturday and Sunday or festive day in the local area of Catalonia or Spain.
      • "WE", "OUR" or "OUR" refers to Globus Voltor, S.L., registered in the Barcelona Mercantile Register in volume 40801, Folio 189, Full B375551, inscription 1 with CIF B64954191 and domiced at Matadepera, BARCELONA c/Camí de Puig Codina, 24.
      • "YOU" or "YOUR" refers to you as a user of our website and/or buyer of any ticket and if you.     2. Each ticket enables a single person as participant of the flight, unless indicated in the same ticket.

    4. The contract may be cancelled by you in accordance with point 13 of the same general conditions.
    5. You must be at least 18 years of age and have legal capacity to buy any ticket.
    6. We reserve the right at absolute discretion, to deny access or change the content of our website, deny any request or order, or cancel any account that you may open with us.
    7. We reserve the right to change these general conditions at any time with respect to the sale of tickets, although they will be applied to you those in force in the contract at the time you make your purchase. You will be responsible for reading these general conditions each time you use our website and its continued use confirms your agreement with the general conditions established when you make a purchase.
    8. If you represent more than one person, you confirm that you have the right and authority to act and make any purchase on your behalf.

  2. Commands
    1. Any order you make by buying tickets from our website is your offer to us to buy tickets. We can send an email to the address you specify in your order, as proof of receipt of your order and details. In any case, these emails do not assure our acceptance of your order.
    1. The price of the tickets you request will be published on our website at the time you place your order. Prices include VAT, where applicable. In any case, there may be errors and the incorrect price for tickets you have requested will be published, and we will give you the option to correct it at the correct prices, confirming or cancelling your order. If we do not contact you, the order will be treated as canceled, but if you have already paid the tickets, the amount will be refunded in full.
    2. You will have to pay for your purchase by credit card or bank transfer. If you do this by credit card, you are liable for the correction of your personal information.
    1. Tickets will be sent by email to the address you have indicated at the time of placing your order. It is your responsibility to print the same to be presented to the pilot on the day of carrying out the flight. The delivery time may vary by being subject to the confirmation of receipt of bank transfer or payment by credit card.
    1. The ticket authorises the holder thereof to participate in a balloon flight according to the conditions of their purchase, as detailed below and which includes:
    2. You will be allowed to fly only the days detailed in you at the time of making your purchase or the corresponding reserve, or according to availability of space for the dates chosen by you. In case of not having space for a flight on the date or preferred area, you will be offered an alternative date and area for approval. In case of no conformity from you and not our availability, you will be extended and extended the validity of the ticket to favour the realization of your flight.
    3. Tickets are valid for a period of 12 months from the date of purchase or any other date agreed between you and us. If the flight is not made within this period, you will lose your right to do ' the, except in cases where it has been extended or its validity for our part.

    1. All tickets are NON-REFUNDABLE except in cases expressly indicated in the ticket. Refund Options:
      • Repayment Maximum – You will be entitled to this reimbursement in case it has not been possible to fly in, at least 7 dates reserved; When the flights have been cancelled by us or by the pilot. The following conditions will apply to this reimbursement:-you will have to notify us in writing that you want the reimbursement instead of flying, within 21 days after the date of the 7th reserve for the last flight attempt will be deducted €10 for management fees per ticket-only the amount of the ticket to the buyer will be refunded. In its defect, we can proceed to the extension of the validity of the same.

      • Partial repayment – you will be entitled to such reimbursement equal to 66.7% of the total paid by the ticket, in case it has not been possible to fly in, at least 3 dates reserved, when the flights are cancelled by us or by the pilot. The following conditions apply to this reimbursement in the event that you decide for this early option:-You will have to notify us in writing that you want the reimbursement instead of flying within 21 days after the date of the 3rd reservation for your last flight attempt.-we may refund the amount of the ticket to the buyer. In its defect, we can proceed to the extension of the validity of the

        same. We will not proceed to make any refund of tickets that have been purchased from another supplier other than us.
  7. Book
    1. When you contact us, please let us know the ticket number and the security code printed on your ticket. We will send you an email confirming the date, time, meeting place and phone number where you will have to confirm the progress of the forecast for your flight sufficiently in advance.
    2. The flight will begin in one of the takeoff zones indicated in our website but we reserve the right to change, without notice, the reserved area, schedule and date. Flights are made throughout the year as long as the conditions permit. The pilot will decide the duration, the direction of the flight and place of landing in good of the security and legal requirements.
    3. We will try to reserve your flight for the date and area you choose. You can only fly on the dates, areas and types of flight your ticket allows unless you access to pay the difference required by us to change the category of your ticket. In any way, bookings are subject to our availability and may be exchanged by us without prior notice for reasons beyond our control.
    4. You will need to bring your tickets with you at the time of submitting to the flight and deliver them. In its defect, the flight will not be provisionsed and you will not be entitled to a new reservation or reimbursement.
    1. You can post-put your flight after having booked a date up to 3 working days before the scheduled date for your flight, by email and/or telephone. In case you contact us to cancel your flight reservation for medical or health reasons less than 3 working days apart, we may require you to present a medical evidence of your inability to perform the flight.
    2. If you are not able to take part of a flight within the validity of the ticket because you are pregnant, we will extend its validity 1 year from the birth of your child. Contact us and send us a copy of the act of birth of the child to proceed to this end.
    3. If you do not participate in your flight on the reserved date then, unless you have changed the date or canceled your booking according to point 8.1 and/or 8.2 you will not be entitled to a new reservation
      or redemption acap. This will not apply if you do not participate in the flight due to cancellation or change of flight date under point 9.
    1. We or the pilot will put under our own or your own decision cancel your flight for any reserved date or alter your schedule and place without notice due to causes beyond our control, for example adverse weather conditions or legal reasons or security. Either way, you will receive the news as soon as possible.
    2. To check that your flight has not been cancelled or post-set you will have to contact us by phone or email in order to confirm your reservation.
    3. In case you have booked a flight on at least one occasion during the first 12 months of the ticket's validity and that the flight has been cancelled by us or the pilot, we will automatically extend the validity of your ticket for 1 more year from your last flight cancellation.
    1. You will have to be in shape to participate in your flight and do not suffer from any illness or unfavourable medical condition or disability that you can prevent from participating or can be affected by your participation in the flight. We recommend looking for appropriate medical advice for this purpose.
    2. You will not have to be under the influence of alcohol or other substances while you participate in your flight. If you are under this influence under our opinion or the pilot, your participation or continuation of your flight will not be permitted. You will not have the right to any reimbursement or a new flight reservation.
    3. When you participate in your flight you must have at least 16 years of age or if you are under 16, only will be allowed your participation:
      • A Pilot's decision
      • If you are accompanied by a responsible adult: you will have to measure at least 1m20cm in height to be able to see above the basket of the balloon and adopt the security position during the landing. If your driver does not allow you to participate in these circumstances, we will refund the purchase price of your ticket within 30 days following the date of your flight reservation.
    4. Hot air balloons are potentially hazardous. You will have to meet all the requirements and instructions of the pilot when you participate in your flight especially anyone who relates to health or safety. You will have to meet wearing comfortable clothes and footwear. In case of not complying with these requirements, the pilot can end their participation in the flight if reasonably believes that this may be dangerous to you or the other participants. The pilot can finish the flight at any time if in his opinion the continuation of the same can be dangerous or contrary to any norm of health and safety. You will not have the right to any reimbursement in any of these cases.
  11. Responsibility
    1. We are not violating this contract between you and us in relation to your flight and we will be missing due to any delay in the preparation of the flight due to causes of some circumstance or event beyond our control or any pilot, including, for example, any strike or industrial dispute, inclemency or error of any equipment.
    1. These general conditions contain all the general conditions of contract between you and us in relation to the tickets and your flight. Thus, you may be sure that any variation made in these general terms will not have been agreed upon and written between you and us.
    2. If you have not received a copy of the general conditions before acquiring the ticket, then unless you notify us in writing within 14 days of the acquisition date of the tickets that do not accept any of the general terms and conditions, it will be considered that you have accepted them in its entirety. If indeed you notify us that you do not accept one or more of these general conditions, and you and us are not able to agree how to modify, you or we may choose between completing the contract with immediate effect by written notice to the other party. In this case, the tickets will cease to be valid and within 30 days of the end date, we shall refund the purchase price of the tickets.
    1. You have the right to cancel the contract with respect to all (or some) of the tickets you have agreed to buy under the contract, at any time until the end of the Duodth day after having received the tickets.
    2. To make use of your right of cancellation you must notify us in writing of the cancellation within the deadline described in point 13.1, giving details of the receipts that are cancelled.

    1. However, point 3.1, we reserve the right to cancel the contract between us if:
      • One or more of the receipts was listed at an incorrect price due to a typographical error or a price information error.
    2. If we indeed cancel the contract we will notify you by email and we will refund your payment within 30 days of your purchase. We will not be obligated to offer any additional compensation for example for disappointment.
  16. The laws of Spain shall apply to the contract and any legal proceedings must be carried out in the jurisdiction of Barcelona.
